Terms of use
The service
masad builds sites for small businesses on the basis of details given in a form. Before any payment you get a link to a preview of the site. The payment, ₪499, covers publishing the site at a personal address, hosting and one update.
The preview is available for a limited time, is marked as a preview and is not meant for publication. Only a payment publishes the site.
The terms are presented in English, Arabic and Russian for your convenience. The Hebrew text is the binding one.
Hosting on a one-time purchase
A site bought with a one-time payment is hosted with us at no further cost for as long as masad operates the service, and for at least three years from the day it was published. An export of your site content is available to you at any time. If we ever decide to discontinue the service after the minimum period, we will give at least 90 days' notice and hand you a full export of the site.
Bought a site with a one-time payment and never joined a subscription? That is the whole relationship: the subscription sections later in these terms do not apply to you.
Cancellation and refund
This section deals with a one-time purchase. For cancelling a subscription see "Cancelling a subscription" below.
For as long as your site has not been published at its permanent address, you may cancel the purchase at any time by writing to the support address, and you will receive a full refund of the sum paid.
From the moment the site is published at its address, the service you bought has been rendered in full: the site was built, published and stands at your disposal, together with the included update round. A cancellation after publication therefore carries no refund, unless the law provides otherwise.
If cancellation provisions under the Consumer Protection Law, 5741-1981 apply to the transaction (in a distance sale, for example), they prevail over what is written here and we will act accordingly.
Cancellation and refund requests are handled by writing to the support address: support@masad.io; a refund, where due, is made by us directly.
Subscription
Alongside the one-time purchase, a site can be had on a subscription plan: the site goes live from the first day, and an ongoing service comes with it.
Basic subscription, ₪49 a month: The site live at your own masad.app address, hosting, transport security (SSL) and uptime keeping, and one light content update a month: swapping text or an image, opening hours, menu items. A redesign or a rebuild is not a light update.
Business subscription, ₪99 a month: Everything in the basic subscription, and on top of it a personal domain included, ongoing upkeep of your presence on Google, the accessibility pack included, ongoing accessibility monitoring, and self-editing of the site.
Annual plan: Basic ₪499 a year, business ₪990 a year. No setup fee is charged on any plan.
Accruing ownership: every shekel counts
On the subscription plan the site becomes yours gradually: every shekel you actually paid on the subscription counts towards ownership, monthly payments and an annual payment alike. Refunds and chargebacks are deducted from the accrued sum.
The bar for full ownership is the sum of the one-time prices of the components included in your subscription, as they stood in the price list on the day of the order. The bar is set once and does not move: price list changes after the order do not change an existing bar. If you add a component to the subscription later, only that component's one-time price is added to the bar, per the price list on the day it was added.
When the sum you have paid reaches the bar, the site is fully yours, for good. From that moment the subscription carries on as a service only: upkeep, updates and everything included in your plan.
Cancelling a subscription
A monthly subscription can be cancelled at any time, in self-service, with no cancellation fee and no persuasion funnel. The cancellation takes effect at the end of the month already paid for; there is no pro-rata refund for the days left.
An annual subscription is non-refundable: the service continues to the end of the year paid for, and the sum paid counts in full towards ownership. Put plainly, the annual payment buys the site: cancel whenever you like, the site is yours either way.
If cancellation provisions under the Consumer Protection Law, 5741-1981 apply to the transaction, they prevail over what is written here and we will act accordingly.
A failed payment
If a charge fails we will not stop straight away: we will try again on the third day and on the seventh, and update you at every step, with a link for updating the payment method. Updating payment details is always done in the payment provider's secured system; your card details are not stored with us and do not pass through us.
If the payment is not settled within 14 days, the subscription lapses, and the following sections apply.
A subscription lapsing before full ownership
If the subscription lapses, by cancellation or by a payment left unsettled, before you reached the bar, the site goes off the air on the lapse date. From that moment a 90 day window opens with two ways on, both of them fair:
To renew: settle the payment or start the subscription again, and the site returns to the air as it was. To buy the ownership: pay the difference between the bar and what you have already paid, and the site is yours, finally.
An export of your content is available to you at every stage, even if you simply chose to leave. At the end of the 90 days, and after one last notice from us, the site is deleted.
Ending a subscription after full ownership
A site already in your ownership, whether you reached the bar or bought the ownership, is not touched. If the subscription ends, only the services stop: self-editing (the site is kept as it is), the upkeep of the Google presence and the accessibility monitoring. The site itself stays on the air.
A personal domain is registered in your name and stays yours. When the subscription ends we will stop managing its renewal for you; if the domain lapses, the site will keep running at itsmasad.app address.
Returning customers
Coming back inside the 90 day window? You carry on from where you stopped, not from the beginning.
A customer who already owns the site and comes back to a subscription signs up for a service-only plan, with no new ownership bar, because the site is already yours.
After deletion, coming back means a new order. We say so explicitly in the last notice before the deletion too.
A self-edited site
The self-editing add-on moves your site, as it was built and at the same address, onto masad's editing platform, and lets you update it yourselves: all the texts, the contact details and opening hours, the services and prices, the questions and answers, the testimonials, the links and the logo. A change you publish goes live at once.
The site's design, its colours and the images placed in it are set at build time and cannot be edited on the platform. Swapping images or changing the design is build work, not a content update.
On a one-time purchase (₪1199): self-editing is part of the site you bought, and the one-time purchase hosting terms above apply to it: available for as long as masad operates the service, and for at least three years; if the service is discontinued, the site is kept in its last state and keeps running, and you receive a full export.
On a business subscription: self-editing is included as a service of the subscription. When the subscription is not active, editing is suspended: the site keeps running in its last state, and no changes can be published on it until the subscription is renewed. If the subscription lapsed before full ownership, the section "A subscription lapsing before full ownership" applies: the site goes off the air until it is settled, and your content is kept.
The platform login details are yours and your responsibility; content you edited yourselves is your responsibility, including its effect on the site's accessibility. A backup of the site is kept with us and exported nightly.
Accessibility pack
The accessibility pack adds to the site we built you an accessibility statement page, an adjustments menu for visitors, and a confirmation that the site conforms to the Israeli standard (SI 5568 part 1) as of the delivery day. The site itself is built accessible from the ground up even without the pack.
The statement is written in the business's name, with the contact details you gave in the order: the business name, the phone and the email. These are the contact details for accessibility enquiries, and it is on you to tell us when they change. We will update the statement at no cost.
Conformance with the standard holds as of the delivery day and for the site as delivered. Content you upload or change yourselves, downloadable documents and third-party content embedded in the site are not covered by the pack. Some of the standard's requirements cannot be checked automatically, and the statement sets out the known limitations.
On the business subscription the pack is included, and the subscription's accessibility monitoring keeps the statement current. On a one-time purchase the statement is a snapshot of the delivery day.
RSVPs, an event page and an album
The RSVP system sends your guests, in your name, a personal invitation, reminders to those who have not answered, a day-before reminder to those who confirmed and a thank you after the event, by email and on WhatsApp. Every message is marked as sent through masad. The designed event page is included, and guests confirm on it.
The guest list is yours. You confirm that you have the guests' consent to receive messages from you about the event. masad holds and processes the details solely in order to place them at your disposal and to send the messages you ordered: no marketing use, no transfer to a third party. A guest who asks to have their details removed can approach you or masad support directly, and we will remove them.
The package is set by the number of guests on the list: up to 300 or up to 600. A list larger than the package moves to the next package for the difference in price. Above 600 guests the system is not sold.
The details are deleted automatically 30 days after the event date. If you bought a service that continues after the event, the album notice for instance, the details are kept until 30 days after the last send you bought, and are then deleted. Until then the list can be downloaded from the personal area at any time; want us to delete earlier, approach support.
The event album shows up to 3,000 photos. The photos are processed for viewing on the web, and the original files are deleted after processing. The album is neither a backup nor an archive of the photos: keep the originals with your photographer or with you. The album stays on the air for 24 months from the day it went up. Towards the end we will send you a reminder, 60 days and 7 days before, and all the photos can be downloaded in a single file up to the last day. After that the album is deleted.
A multilingual site
A multilingual site shows your site in the language you ordered it in and in the further languages you chose, out of Hebrew, English, Arabic and Russian. Visitors move between the languages with a button on every page, and each language gets an address of its own.
The texts in each language are written afresh from what you gave us, to the best of our ability. We do not undertake full fidelity between the versions and the Hebrew wording. A correction you ask for is made at no cost.
A site in two languages: ₪799. Each further language: ₪199. Adding a language to an existing site: ₪299 for the first language and ₪199 for each further one.
At an event, the invitations, the reminders and the RSVP form reach each guest in the language you noted on the guest list. With nothing noted, in the event's language.
